ISLAMABAD: Justice Mansoor Ali Shah and Justice Munib Akhtar of the Supreme Court of Pakistan issued a new letter on Wednesday to clarify their positions regarding the recently published minutes of the Judicial Commission meetings.
In their correspondence, both justices explained that, as members of the commission, they had agreed to convene a full court to review the 26th Amendment. They emphasized that the case was not scheduled for hearing, which was a violation of the decision made by the committee. They also mentioned that they had sent a follow-up letter on November 4, pointing out that the case had still not been fixed for hearing.
The justices pointed out that they were not provided with the notes written by the Chief Justice concerning their decision. They stated that the Chief Justice had read out his notes during a meeting of the Judicial Commission. They further clarified that the Judicial Commission was not the appropriate forum to resolve this matter.
Additionally, they noted that the minutes of the Judicial Commission meetings claimed that the issue of forming a bench had been referred to the Constitutional Bench and the Constitutional Committee. However, they clarified that neither the Constitutional Bench nor the Constitutional Committee existed at that time.
