Islamabad: Justice Athar Minallah has objected that the cases related to elections were under hearing in the high court despite that the suo motu notice was taken by the Supreme Court.
Justice Athar Minallah, who was part of nine-member larger bench earlier constituted for hearing the suo motu notice of elections in Punjab and KP, has issued a 25 page- detailed dissenting note today.
Justice Athar Minallah said that the manner the action taken on the PTI petition the top court engulfed in political dispute.
He said that if full court were constituted than the political dispute would have been avoided.
He said that the PTI chief Imran Khan tendered resignation after no-confidence motion instead going towards the opposition which fulled the political crisis.
Justice Athar Minallah said that sumo motu notice was rejected by 4-3 adding that the suo motu notice action engulfed the court unnecessary political dispute.
He said politicians loss or win after bringing their cases into the court but the court always defeat in every condition.
He said that the top court didn’t learn anything from the past.
