Govt moves fresh review petition against SC order on Imran Khan’s hospital transfer

ISLAMABAD: The federal government has filed a fresh review petition in the Supreme Court challenging its August 18 order concerning the transfer of PTI founder and former prime minister Imran Khan to a hospital for medical assessment and treatment.

According to sources, the miscellaneous petition was submitted by the Chief Commissioner Islamabad after the objections raised by the Supreme Court Registrar’s Office against an earlier plea were removed.

In its new application, the government has argued that the Supreme Court’s order contains legal deficiencies and that the relevant prison rules governing inmates’ medical treatment were not fully considered before the decision was issued.

The petition also contended that the Chief Commissioner Islamabad was not named as a party in the original proceedings and therefore did not receive an adequate opportunity to present his legal and administrative position before the court.

The government has requested the apex court to admit the miscellaneous petition and review its August 18 order regarding Imran Khan’s transfer to hospital.

According to the plea, the matter should be reconsidered in light of the applicable legal framework, administrative considerations and prison regulations relating to medical facilities and treatment for prisoners.

The latest petition was filed after an earlier review application was returned by the Supreme Court Registrar’s Office due to objections. The government subsequently addressed those objections before submitting the fresh plea.

Meanwhile, Information Minister Attaullah Tarar said PTI founder Imran Khan was returned to Adiala Jail early Friday after undergoing a medical examination at Islamabad’s Pakistan Institute of Medical Sciences (PIMS).

The Supreme Court had earlier ordered that Imran Khan be shifted to Shifa International Hospital for medical assessment and treatment in view of concerns regarding his health. However, the government said he was taken to PIMS for examination, where doctors from Shifa were also present, before being transferred back to prison.
