LAHORE: Lahore High Court (LHC) judge Justice Mohsin Akhtar Kayani resigned from his position on Wednesday, expressing serious concerns over the 26th and 27th Constitutional Amendments and the independence of the judiciary.
In his resignation letter, Justice Kayani raised concerns about the growing influence of the executive in the appointment and transfer of judges, saying the situation had undermined public confidence in judicial independence and the administration of justice.
He observed that ordinary litigants were encountering increasing difficulties in accessing justice, while the needs of those seeking legal relief were being neglected.
“ My conscience does not permit me to remain in the position of a judge,” he stated, citing personal reasons, health concerns following recent surgery and his conscience as factors behind his decision.
Justice Kayani described his service at the Islamabad and Lahore High Courts as an honour. He also noted that he had decided more than 23,000 cases of various kinds during his judicial career.
He said he had consistently endeavoured to uphold the Constitution, safeguard fundamental rights and deliver justice without fear or favour. He emphasised that judicial office was inseparable from judicial independence, loyalty to the Constitution and respect for human dignity.
Following his resignation, Justice Kayani said he intended to continue serving the public and defending people’s rights through legal practice.
He has also forwarded a copy of his resignation to the registrar of the Lahore High Court.
